Why Do You Need Buyer Agency?

Traditionally real estate agents represent the Seller because it is the Seller who pays the commission. If the Realtor is representing the Seller, his/her fiduciary and legal responsibilities are to that Seller, not to the Buyer. That means any confidential information the Buyer may reveal to the Realtor must by law be passed on to the Seller thus creating a conflict of interest situation for the Realtor and potentially eroding the bargaining position of the Buyer. Also if the Realtor is aware of any problems associated with the property, or if the Realtor feels or knows that ownership of this property may not be in the best interests of the Buyer, the Realtor has no legal obligation to reveal that information to the Buyer.

In short, the Realtor is under no moral or legal obligation to act in the Buyer's best interests. Why Do You Need Buyer Agency?

A Seller Agent acts in the best interests of the Seller, often at the expense of the Buyer. A Dual Agent acts for both the Buyer and the Seller. In Ontario if a property is listed with the office of the Agent working with the Buyer, that Agent is automatically a Dual Agent and must act for both the Buyer and the Seller.
